Hello Attorneys / Experts,
Thanks for this great service... Appreciate if you can pl provide your inputs to my situation below :
Jan'09 : My Employer submitted H1B - Vacation Recapture + Extension based on pending I-140
Feb'09 : RFE was issued asking information related to Company
Feb'09 : H1B - 6 Years completed : H1B Visa / I-94 Expired in Passport
Mar'09 : RFE responded with the requested information
Apr 10, 2009 : USCIS Denied H1B Extension petition.
I understand from my employer that I can no longer be on the US payrolls and that I've to leave the country in 180 days.
Is Motion to Reopen (MTR) / Appeal is an option to legally stay in US ? If MTR is submitted, can I continue to work for the employer / client and get paid ?
Appreciate your inputs in this area.

HI,
I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

A new poll from ABC News shows a seemingly contradictory result. Nearly six in ten support the controversial Arizona law SB1070. That will make the Tea Party crowd happy. But the buried headline is that almost the same number support legalizing illegally present immigrants. Why the seemingly conflicting data? I think it shows Americans want action on reforming what they perceive is a broken immigration system. Americans are not anti-immigrant just because many support SB1070. They are upset that Congress and the President have refused to deal with immigration and are giving credit to states taking matters in to their...

It is advisable to file change of status to h4 while in USA, no need to go back to india. After you get your h4 approved then you can go for stamping...

Hello:
I got two EAD extensions in past and applied for the same third time. Earlier, EAD Renewals took only 2 weeks time ( from VSC). But this time it is not the case. It is still pending for 4 weeks now.
Are there any recent EAD renewals from TSC for anyone? Please let me know if anybody has similar case?
PS: Since my case(I-485) was transferred from VSC to TSC, I applied for EAD renewal at TSC this time.
Thanks

The analysis of census data from both the U.S. and Mexican governments, being released Wednesday by the Pew Hispanic Center, highlights the impact of the economic downturn on Mexican immigrants, many of whom enter the United States illegally. The study found that immigrants arriving from Mexico fell by 249,000 from March 2008 to March 2009, down nearly 60 percent from the previous year. As a result, the annual inflow of immigrants is now 175,000, having steadily decreased from a peak of 653,000 in 2005, before the bursting of the housing bubble dried up construction and other low-wage jobs.
The total population of Mexican-born immigrants in the U.S. also edged lower in the past year, from 11.6 million to 11.5 million, according to the study by Pew, an independent research group. Up to 85 percent of immigrants are believed to be in the country illegally.
